Terms & Conditions
To enter The Coffee Club 'Guess How Many Beans' promotion you must be an Australian resident.
None of the following are eligible to participate: (i) Employees and immediate family members of employees of any of the promoter, their respective franchisees, subsidiaries, agents and advisors, (ii) other persons assisting with the promotion, (iii) any syndicate or collection of persons acting in concert, (iv) any person using the services of an entity carrying the business of entering (or advising on entering) prize promotions and (v) any such entity.
This promotion starts on Friday 14 August 2009 12.00am and concludes on Wednesday 30 September 2009, 5.00pm.
Visit www.wherewillimeetyou.com/drinkresponsibly to enter and follow the promotional links. Fill in your details including name, email, mobile number and your guess of how many beans on the online entry form provided. Your guess will be entered into a database and the first person to guess the correct amount of beans wins the prize.
Limit of one entry per person. Only entries completed on the online form will be accepted. Only entries with all details completed will be eligible.
ALL ENTRIES MUST BE ENTERED ON THE WEBSITE BY 5.00PM WEDNESDAY 30 SEPTEMBER 2009 AND ENTRIES RECEIVED AFTER THIS DATE WILL NOT BE INCLUDED IN THE COMPETITION.
All valid entries received will be collected by The Coffee Club and entered into a database by date order of guesses. The website will continue to collect entries up to the end of the promotion end date even if a correct guess has been entered. In the event that any entry drawn is invalid or adjusted void then the Promoter may award the relevant prize to the next valid entry drawn (but the Promoter shall not be obliged to do so). All unawarded or unclaimed prizes will lapse if not the subject of valid claims within the time limits and in the manner as prescribed by these Rules.
The prizewinner will be notified that they have won by the phone number on the entry form within 30 days of the closing date of receipts.
In the event that a prize remains unclaimed after 30 days the prizewinner will forfeit the prize. No redraw will be conducted.
The prize is $1,400 redeemable for coffees for one (1) year (1 October 2009 to 30 September 2010) at a nominated The Coffee Club store (nominated by the prizewinner). The prize is awarded conditionally upon acceptance by the winner of the terms and conditions of the prize provider. Prize may not be exchanged and there is no other alternative.
Details of prizewinner's name and suburb may be published by The Coffee Club. As well as details of name, you agree that, should you be a winner of the Prize, then the Promoter may publicise statements made by or attributed to you relating to the Promoter or this or any other promotion or offer together with your likeness, unless otherwise requested.
The prizewinner's name is available by sending a stamped SAE to The Coffee Club Franchising Company Pty Ltd, addressing it to "Guess the Bean Competition', PO Box 5786 West End QLD Australia 4101.
To the fullest extent permitted by applicable law (but not otherwise) the Promoter and their respective agents assume no responsibility and are not liable for
(i) the accuracy or otherwise of the prize description or illustration, (other than those warranties or conditions implied by statute and which cannot be excluded) any representation, warranty, condition or guarantee in respect of a prize
(ii) The non-availability, failed, loss, late receipt, interception or damage of any prize-claim, prize, notification or other
communication, or any taxes, fees, charges or other costs which winners may be required to pay any time in connection with a prize, (save to the extent that the Promoter has expressly and specifically accepted responsibility in these terms and conditions for the same).
The promoter is The Coffee Club Franchising Company Pty Ltd. The Coffee Club may (i) extend any time limit or waive any of the terms and conditions where a person might otherwise have been disqualified (without obliging the Promoter to relax the terms and conditions in any other case whatsoever), (ii) terminate or suspend the Promotion at any time due to supervening circumstances beyond the Promoter's control, and (iii) decline to enter into any correspondence save as otherwise stated in these terms and conditions.
The Coffee Club will observe the Advertising Standards Bureau Australia and Australian Code for Promotion Marketing Practice when extending any deadline or otherwise exercising or relying upon any of its rights and remedies in these terms and conditions. Nothing in these terms and conditions shall affect your statutory rights.
In administering this promotion, the Promoter may collect personal information from you and, unless it has first obtained your consent, the Promoter (i) will not collect more of your personal information that it needs for the purpose of administering and analysing this promotion, or directing mail, special offers or other promotions to you (ii) will only use your personal information for that purpose which may include transferring your personal information to its associates, and (iii) will not transfer your personal information outside of Australia unless it is permitted to do so under the Commonwealth Privacy Act 1988. Any enquiries about your personal information should be submitted in writing and sent by pre-paid post to the Prize Draw address stated above marking your envelope "Data Protection Request".
By placing your entry in the draw, you are giving permission to The Coffee Club Franchising Company Pty Ltd to contact you with special offers, promotions and direct mail.
Any entry will be void if it is deemed (in the Promoter's discretion) to be incomplete, torn, tampered or unreadable.
All instructions, terms and conditions on any promotional material relating to this promotion form part of these provisions, provided that in the event of any conflict or inconsistency these provisions shall prevail over all such other instructions, terms and conditions.
Acceptance of these terms and conditions is a condition of entry. These terms and conditions are subject to interpretation under the law of Australia, and the jurisdiction of the courts in Australia. All entries are the property of The Coffee Club.
A copy of these terms and conditions is available by sending a stamped SAE to The Coffee Club Franchising Company Pty Ltd, addressing it to "Guess the Bean Competition', PO Box 5786 West End QLD Australia 4101.marking your envelope 'Terms & Conditions Request" to arrive prior to 6 weeks after the promotion.
